The lawsuit brought by a Rochester-area woman, claiming her husband was wrongly declared dead at a Buffalo-region hospital, is garnering national media attention.

The lawsuit and its allegations will be featured in a segment on CBS This Morning on Monday, according to Rochester attorney Charles Burkwit, who is representing Tammy Cleveland, the widow of Michael Cleveland.

In 2014, Michael Cleveland died after suffering a heart attack at a Tops grocery store in the Buffalo area. According to the lawsuit, a doctor at DeGraff Memorial Hospital wrongly declared him dead once, then ignored his family's pleas for help for nearly two hours as Cleveland fought to breathe.

He died nearly 14 hours later at Buffalo General Hospital, where he was transferred after a recognition that he was alive. By then, Burkwit said, efforts to unclog a blocked artery were too late to make a difference.
